大陸運動法學研究現況

摘要

由於職業運動的迅速發展，以及運動的高度商業化，運動與法律的關係益形密切。世界各國自1960年代起，伴隨著體育運動立法熱潮的興盛，開始了運動法學的研究，至今已有相當可觀的成就。我國的運動法學研究起步較晚，投入研究的人力及資金相對匱乏。但由於運動的高度職業化、商業化及全球化，運動法學在我國未來勢必扮演重要角色。本研究以文獻分析法探討大陸運動法學的著作、期刊、國家獎助、專業學會及設置系所的現況，以提供我國未來發展運動法學研究之參考。

 Abstract

With the rapid development and the high commercialization of professional sports, the relationship between sports and the law has become closely connected. The worldwide study of sports law began in 1960’s followed by the upsurge of sports lawmaking, and quite a lot of respectable results had been achieved ever since. The study of sports law began much later in Taiwan so that the manpower and capital devoted to it were relatively inadequate. However, due to the high professionalization, commercialization and globalization of sports, sports law in Taiwan will definitely play a very important role in the future. The study, based on literature analysis, explores the current states of China’s sports law articles, periodicals, national scholarships, Sports Law Associations and the establishments of university departments. In order to provide references to the development of future sports law research in Taiwan.
